Lawyers Against WCB (WorkSafeBC) - Workers' Compensation Matters
Lawyers Against WCB in Vancouver, Victoria, and Surrey, BC
Mr. Gosal has over 31 years of experience in the area of WorkSafeBC (“WCB”) claims and appeals. Since 1993, he has represented over 5,500 injured workers.
Navigating the WorkSafeBC appeals process is frustrating, daunting, and often stressful. Our lawyers have extensive legal and practical experience in all aspects of WorkSafeBC claims, assisting our clients at every step of the process. We review each communication from the Board in detail and we manage all necessary appeals on your claim. We provide advice on how to conduct yourself with WorkSafeBC staff, doctors, and third-party contractors. We offer guidance in obtaining independent medical and vocational assessments to further strengthen your case. Ultimately, we provide experienced representation before the Review Division and the Workers’ Compensation Appeal Tribunal.
In choosing the right legal representative for you, experience is vital, and you should ask any prospective lawyer how long their firm has existed and how long they have practiced exclusively in workers’ compensation matters. Gosal & Company was incorporated and has continually specialized in WorkSafeBC cases since 1998. Sarj Gosal has exclusively practiced in the area of workers’ compensation law (WorkSafeBC) since 1993.
WorkSafeBC Review Division Appeals
We assist you in filing your initial WorkSafeBC appeal to the Review Division. Comprehensive succinct written submissions are provided to the Review Division based on your input and the supportive facts, medical evidence, and law and policy in your WorkSafeBC file.
Workers’ Compensation Appeal Tribunal (“WCAT”) Appeals
As WCAT is the final level of appeal, our lawyers will (with your input) carefully assess the merits of your appeal and will work with you to gather the expert evidence required to best advance your appeal.
Most appeals require an oral hearing and we will ensure that you are well prepared to answer our questions, as well as possible questions from the WCAT Vice Chair. Comprehensive oral and (in many cases) written submissions are prepared to ensure that the strongest possible case is put forward on your behalf.
Claims Management
A large percentage of our clients retain Gosal & Company early on in the claims process as they are aware of difficulties with WorkSafeBC-related claims faced by friends, relatives, and co-workers. Once retained, we can advise you each step of the way through your claim, and ensure that you appeal all decision letters that a layperson would not realize must be appealed.
If further claims decision letters are required, we can proactively ensure that your Case Manager will formally address all physical and psychological diagnoses in your file.
As the appeal system has strict deadlines, and due to the fact that wait times for treatment, diagnosis and medical opinions are lengthy, it is prudent to have timely advice regarding this evidence.
Reopening of Claims
If you have an accepted WorkSafeBC claim, it may be possible to reopen your claim if there has been a significant change in your compensable physical and/or psychological condition. We can assist you in reopening your claim for further compensation (including wage loss benefits, Vocational Rehabilitation assistance, and pursuing increased long-term disability benefits).
